Abstract
That in any institution of government, but most especially so in one of pro-fessed democratic proclivities, the drawing, legitimatizing, and interpolation upon the subjects of that government, of any legislative measure, which, under the false banner of indispensability, takes away a thing of import in the enjoyment of personal liberty, becomes a mere mockery if there is present, no sentiment or innate under standing of the necessity of such a prohibition back of that law. To show the veracity of this statement will be the purpose of this paper. The method followed will involve chiefly an investigation of the historical background of the 8th Amendment, of the organization backing it, the conflict of this amendment with rights of the individuals, and finally, an observance of the futility, both, of the law· itself, and of an immediate attempt to remedy it.
