Abstract

Since this paper was written, it appears that two of the cases on which I have relied have been overturned. I quote the following from the Dec. 15, 1969 issue of U.S. News & World Report at p.102. "Unequal pay of women. Two banks argued that they legally could pay female employes less than males for the same type of work because there was a training program to prepare men for executive posts. A federal district court agreed. But now a U.S court of appeals has rejected the claim, saying the training program was so "informal" it did not meet Labor Department standards." Apparently, the reference is to the cases cited in footnote 48 of this paper. Because the courts full opinion is not available, it is impossible to elaborate on the subject at this time. However, employers relying on the "training program " exception should be mindful of these developments.
