Abstract

During the construction period of a project, disputes sometime arise between the owner and the contractor concerning claims by the contractor for extensions of time or payments of extra costs. If such claims cannot be amicably settled, they must be either dropped by the contractor or be decided by arbitration, appeal boards, or the courts. In the past ten years there has been a rapid increase in the number of construction disputes. Furthermore, unresolved disputes on many projects have led to time consuming and costly arbitration or litigation. Statistics on some major projects constructed nationwide in the past few years indicate that the settlement cost of construction disputes can amount to from 10% to 40% of the construction contract cost (Weiland, 1982).
